These Terms of Service (“Terms”) govern your access to and use of the Martian Wealth mobile app, websites, and related services (together, the “Service”), operated by Nyaliens, Inc. (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of these terms
By accessing or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Service. The Service is intended for personal, non‑commercial use in jurisdictions where it is lawfully available.
3. Your account
- You agree to provide accurate, current information when you register and to keep it up to date.
- You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
- You must notify us promptly at support@martianwealth.com if you suspect any unauthorized use of your account.
- You may use third‑party sign‑in (Google or Apple) subject to those providers’ terms.
4. What the Service does
Martian Wealth helps you view and understand your personal finances by securely connecting to your financial accounts and generating dashboards from your data based on the requests you make. The Service is an informational tool. We do not move money, make payments, or act as a bank, broker, or financial institution.
5. Connecting financial accounts
To use core features, you may connect financial accounts through third‑party providers such as Plaid and Apple’s FinanceKit. Your use of those services is also subject to their respective terms and privacy policies. You authorize us to access, retrieve, and store information from your connected accounts as described in our Privacy Policy.
Account information, balances, transactions, and prices are provided by third parties and your financial institutions. We do not guarantee that such information is accurate, complete, or current, and you should always verify important figures with your financial institution.
6. Not financial advice
The Service provides information and visualizations for your convenience only. It does not constitute financial, investment, tax, accounting, or legal advice, and nothing in the Service is a recommendation to buy, sell, or hold any security or to make any financial decision. You are solely responsible for your financial decisions and should consult a qualified professional where appropriate.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Access or attempt to access another user’s account or data.
- Reverse engineer, decompile, scrape, or interfere with the Service or its security features.
- Circumvent rate limits or place an unreasonable load on our infrastructure.
- Upload malicious code or attempt to disrupt the Service.
- Use the Service to build a competing product or to resell access.
8. Intellectual property
The Service, including its software, design, logos, and content (excluding your own data), is owned by Nyaliens, Inc. and protected by intellectual‑property laws. We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the Service for its intended purpose. You retain all rights to the financial data you connect; you grant us the limited rights needed to operate the Service for you.

11. Limitation of liability
To the maximum extent permitted by law, Nyaliens, Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 100.
12. Indemnification
You agree to indemnify and hold harmless Nyaliens, Inc. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. On termination, the rights granted to you under these Terms will end, and we will handle your data as described in the Privacy Policy.
14. Changes
We may modify the Service or these Terms from time to time. If we make material changes, we will provide notice (for example, in‑app or by email) before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
15. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict‑of‑laws principles. Any dispute not subject to mandatory arbitration or small‑claims jurisdiction will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
